A cease and desist letter is the best way to do that, but here are a few things you need to know about emailing notices and how it could affect your legal copyrights. Email Delivery Yes, however, if the matter is serious and you really will take further legal action if your cease and desist order is ignored, you probably should not send an email to rely on as proof of sending a request. Emails can be easily faked and doctored, backdated, and altered after the fact making it difficult to prove which version is valid when the two opposing parties present a judge with two different versions both claiming to have the real version. Instead, do invest in the small amount of money it takes to send a letter via certified, return-receipt and ask for a signature be obtained from the addressee.  This will serve as far more convincing and will carry more weight in a court of law than an email or even a letter sent without a signature requirement. It can be difficult for a judge to decide which email version is for real: yours or the one the defendant says is different (and may have doctored) and this could result in a case being thrown out, damages being minimal, or even penalties or charges may be assessed for tampering with legal documents. It is also difficult to prove that just because you sent an email that the correct person received it. Emails can get lost in a spam folder, a recipient may see a return receipt requested and delete it, or if there are multiple users on an email account, claim that it was sent to someone else and you violated their privacy rights. Staying Out of Court Using more formal channels of communication (certified letter) than an email also sends the message that you are very serious about your demands listed in your cease and desist letter.  This alone might be enough to get the (alleged) offender to stop what they are doing.  Ultimately, it is usually better when business disputes can be resolved without going to court.  Lawyers and court proceedings can be expensive, and your case could take months or even years to be heard. If someone has grievously caused you harm in some substantial way, you may have what is called a tort.  If so, it is worth talking to a lawyer because you may be entitled to more compensation when a tort can easily be proven to have occurred. When to Use Email Email is not necessarily always the wrong approach.  For all the pesky little infringers out there who have a picture of yours on a blog or website,  an email is probably fine because you are not likely to ever take action against certain people.  But if you do think you may want to protect your legal rights talk to  a lawyer who specializes in intellectual property rights first, or send a certified letter- and get a signature!

Boat Design Open Sea Engineers Boat Design Open Sea Engineers Boat Design: An Open Sea for Mechanical Engineers Mechanical engineers can visualize themselves easily in a buzzing power plant or by an old boiler, but how about flying in a sailboat or powerboat, ripping through gorgeous strands of blue sea? Boat design offers adventurous opportunities for those with a natural affinity for the water, to go along with critical thinking skills. William Lasher, professor of mechanical engineering at Pennsylvania State University, who has spent the last decade focused on sail dynamics, says this is a field that becomes passion as much as career. Yacht design, for example, puts you up against the structural issues of racing boats, focusing on incredibly complex loading conditions, Lasher explains. Show even a couple percent improvement in the speed and its a major difference. Lasher utilizes finite element analysis, looking at areas such as hydrodynamic resistance of the boat in flat water versus performance in waves, or, for powerboats, the design of the propeller to correspond with the engine. When it comes to finite analysis, especially at the higher end of racing boats for structure, one of the places used a lot is in the design of keels, he says. They hang on the bottom of the boat and it serves the purpose of keeping it from slipping sideways but is made out of lead. Some more recent boats are using canting keels to swing the boat sidewise, shifting from one side to the other to get better stability while dealing with the loads on them. When youre doing that with tens of thousands of pounds, you need to get pretty exact. Where It Begins Lasher says design can often start with a blank sheet of paper. Youre writing down the basic parameters of the boat: how long, wide, weight, how much sailing are you putting on it, what conditions are you sailing in, he says. A velocity prediction program is used to take these parameters and find an equilibrium balance between the forces on the sails and the forces on the hull. Professor Lasher says that boat design can often start with a blank sheet of paper. The sails are trying to push it forward and sideways and the hull offers resistance, he says. And thats the most interesting thing about ithow a very complex system interacts with everything else and its hard to change one thing and not have it affect something else. Its the tradeoffs of constantly putting more sail on it, then needing more stability, he adds, or making the boat wider but then affecting the center of gravity. Youre trying to improve the performance but dealing with the penalty of improvement. For cargo ships, Lasher says designing is adjusted more to the economic impact, trying to carry as much cargo as you can safely for the lifespan of the ship and safety of the passengers. These ships have tremendous loads and need to design a structure to support them; thats whats driving you when you consider the cost if your design is off, he says. I remember when I was a student we went to a Society of Naval Architects meeting and toured an SL7 (sealand ship) and went down below. Youd be just amazed by the six inch-thick metal plates, how much material goes into it its a lot to manage. Where Do I Sign? But how do you get involved? Lasher says a good way is to get a Masters degree in naval architecture as he did, feeling that combining this with a Bachelors degree in mechanical engineering would give someone a good chance to pick up what boat designing requires. But you must also be committed to continuing to educate yourself long after the diplomas. There are a number of good books out that outline processes and techniques at various levels, he says. But the Bible is really Skenes Elements of Yacht Design revised by Kinney. Finally, Lasher says youll need one more thing: patience. Someone once said to design a [large] ship you have to take the Empire State Buildings structural issues, turn it on its side and run it through waves of 25 knots, he laughs. We also discussed the need to unlearn the idea that winners dont need to hustle for their next jobs â€" that recruiters will always be calling them, and if they fail to call you, then you are a loser. Today, well discuss another popular career concept that needs to be unlearned: the idea of climbing the corporate ladder. Climbing Corporate Ladders One pervasive component of early-to-mid-twentieth-century thinking about careers was the concept of climbing the corporate ladder of success. This framework used the corporation or institution as the economic foundation of  upward mobility. In this context, success meant ever-increasing levels of job titles, salaries, and responsibilities within the same organization. This ladder-climbing framework may continue to  be viable for large companies and institutions with sophisticated approaches to management development, but how many of those organizations still exist? What is the probability that you will  work for one of them? Most of the people whose career campaigns we manage will end up working for smaller companies with espoused philosophies that people are our most important product â€" yet these companies will also conduct themselves according to a just in time approach to leadership succession. Rather than paying the cost of in-house leadership development, the company will decide it wants someone who can hit the ground running when an important leadership role opens up. The company will find this person by employing retained search firms to source  the most qualified candidates both inside and outside the company. The higher up the organizational ladder an open role is, the higher the bias in favor of hiring outside the company. Given the drive for doing more with less, in-house employees are struggling to simply perform the jobs they were hired to do. They lack the time â€" and the company does not provide them with the resources â€" to demonstrate fitness for higher-level jobs. The Devil You Know Is at a Disadvantage Under these circumstances, promoting in-house candidates to higher management roles can sometimes be perceived as being as much a leap of faith as hiring an outside person is. Consider the popular term the Peter principle, which refers to the idea that managers rise to the level of their incompetence because people are hired for new roles based on their competence in their current roles â€" not their competence in the new role. It  would be an error to assume that the best sales professional in the company will be the best sales manager. It would be an error to assume that a baseball teams best pitcher will be the best coach. As one ascends the corporate ladder, jobs increase in responsibility â€" but they also require different skill sets. Thus, when hiring an internal candidate for a leadership or management position, a company runs the risk of enacting the Peter principle. Another problem for internal candidates is that it is riskier for hiring authorities to promote internal candidates than it is for them to hire external candidates. The popular cliche is that the devil you know is better than the devil you dont know. That cliche breaks down in the hiring process. Finding out the devil you didnt know has problems opens the hiring authority to accusations of making bad decisions under conditions of incomplete information. From Ladder Climbing to Traversing The 50 successful people we interviewed for this series of articles did not think in terms of ladders. They thought in terms of traversing. The skiing term traversing means moving in a zigzag pattern along different snow terrain. During an alpine ski run, you may traverse over ice patches, powder snow, or moguls (snow mounds). Moving up a ladder requires steady discipline and persistence in the face of obstacles. Traversing requires discipline combined with maneuverability. Schools are excellent at educating students about discipline and persistence in the face of obstacle. From kindergarten to doctoral programs, one must pass through a hierarchy of required courses to pass on to the next hierarchy of required courses. Running through the educational systems gauntlet is a demonstration of intelligence, discipline, and persistence. All of this means that traditional schools are excellent at teaching students how to climb ladders that will not exist for them once they graduate. The key skill professionals need in todays assignment-based economy is not ladder-climbing, but the agility of traversing. Back to the Case of Jack In the previous article,  we discussed the case of Jack: Jack needed to understand and accept that his career may have begun as an employee, but it would most certainly end as a consultant. Jacks career would not be a single career comprising a series of corporate jobs. It would be more like managing two professional lives, one focused on employment assignments and the other focused on project assignments. This is what we call traversing as opposed to managing one single career. This new model involves zigzagging between full-time and project work, moving from W-2 to 1099 and back to W-2. Today’s latest study, published Monday in the journal  JAMA Internal Medicine,  says drinking coffee will help extend your life span.  In a study of 9 million British male and female adults, coffee drinkers had a slightly lower risk of death over 10 years (10 to 15%) than those who didn’t drink it regularly. Most of the subjects (154,000) drank two to three cups per day and 10,000 of them drank at least eight cups every day!This study echos other recent studies that shows the positive health affects of daily coffee consumption.  Coffee can help you on those long summer daysBut something people may not realize that is also beneficial when it comes to coffee, especially during these sweltering summer months, is that coffee does not dehydrate you.    Ã¢€œIn a healthy body,  it’s very unlikely that a few cups of coffee are the cause of your dull skin, or headaches, or overall feeling of dryness- at least, not through the mechanism of dehydration,”  Jennifer Haythe, M.D., a cardiologist and internist at Columbia University told MarieClaire.com.  Actually caffeine can keep you more hydrated than other liquids because you are drinking it with a volume of fluid like iced coffee or tea. A 2014 study found that there was zero evidence of dehydration with moderate daily coffee intake.  We’re not saying you should drink a giant cup of scalding coffee after a workout instead of water or gatorade, but you can’t put all the dehydration blame on your morning grande latte.

It defines the environment in which employees work. Company culture includes a variety of elements, including work environment, company mission, value, ethics, expectations, and goals. For example, some companies have a team-based culture with employee participation on all levels, while others have a more traditional and formal management style. Other companies have a casual workplace without many rules and regulations.   Google is an example of an organization with a clear company culture. According to the website, the company still feels like a small company with an informal atmosphere, even though it has grown tremendously: At lunchtime, almost everyone eats in the office café, sitting at whatever table has an opening and enjoying conversations with Googlers from different teams… Every employee is a hands-on contributor… no one hesitates to pose questions directly to Larry or Sergey in our weekly all-hands (“TGIF”) meetings â€" or spike a volleyball across the net at a corporate officer.
